§ 1 Scope of application
(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between Kothagudem K&B UG (haftungsbeschränkt), Märkisches Allee 312, 12687 Berlin (hereinafter "Provider" or "we") and the customer (hereinafter "Customer" or "you") via the online shop www.aahaar.de.
(2) The version of the GTC valid at the time of the order shall apply.
(3) Deviating terms and conditions of the customer are not recognised unless the provider expressly agrees to their validity in writing.

§ 3 Conclusion of contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order (invitatio ad offerendum).
(2) By submitting an order via the "Place binding order" button, you make a binding offer to purchase the products in the shopping cart.
(3) Acceptance of the offer is made by sending an order confirmation by email. The purchase contract is concluded upon receipt of this email.
§ 4 Prices and payment
(1) All stated prices are final prices and include the statutory VAT of 7% for food products pursuant to § 12(2) No. 1 UStG. The standard rate of 19% applies to non-food items.
(2) In addition to product prices, delivery costs may apply. Details can be found in § 5 of these GTC and in the information provided during the ordering process.
(3) Payment is processed via the payment service provider Stripe. Common credit and debit cards are accepted. Your card is charged when the order is placed.
§ 5 Delivery and shipping costs
(1) We deliver exclusively within Berlin (postcodes 10xxx–14xxx).
(2) Delivery is free of charge for orders of €40.00 or more. For orders below €40.00, we charge a flat delivery fee of €4.99.
(3) There is no minimum order value.
(4) Delivery is made to the specified delivery address. Handover is confirmed via an OTP process (one-time password sent by email).
(5) Delivery times will be communicated by email after the order is received.
§ 6 Retention of title
The delivered goods remain the property of the provider until full payment has been made.
§ 7 Right of withdrawal
Consumers are entitled to a statutory right of withdrawal. Details can be found in our withdrawal policy.
Please note: For food products that are liable to deteriorate quickly or pass their expiry date, there is no right of withdrawal pursuant to § 312g(2) No. 2 BGB. For packaged, shelf-stable food products (e.g. rice, spices, flour, lentils), the 14-day right of withdrawal applies, provided the packaging is unopened and the goods are undamaged.
§ 8 Warranty and defect liability
(1) Statutory warranty rights apply.
(2) If delivered goods are defective, please contact us immediately at hello@aahaar.de. We will endeavour to find a swift and fair solution (replacement delivery or refund).
(3) Please check the delivered goods upon handover for completeness and visible damage. Please report obvious transport damage immediately.
§ 9 Cancellation by the customer
(1) As long as an order has the status "pending", the customer can cancel the order directly via their customer account.
(2) Once processing has begun, cancellation is only possible after consultation by email to hello@aahaar.de.
(3) Payments already made will be refunded via the original payment method in the event of a successful cancellation.
§ 10 Liability
(1) The provider is liable without limitation for intent and gross negligence, as well as for damage resulting from injury to life, body or health.
(2) In the case of slight negligence, the provider is only liable for breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to foreseeable, typically occurring damage.
(3) The above limitations of liability do not apply to claims under the Product Liability Act.

§ 12 Dispute resolution
(1) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/
(2) We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration body.
§ 13 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn.
(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the registered office of the provider (Berlin).
(3) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected.
